As of May 28, 2024, qualifying facilities are required by the EPA to develop a facility response plan for a worst-case discharge of Clean Water Act (CWA) hazardous substances or threat of such a discharge.
The requirements of the new regulation apply to any facility that has a maximum on-site quantity of a CWA hazardous substance that meets or exceeds threshold quantities, is located within one-half mile of navigable water or conveyance to navigable water, and that meets one or more substantial harm criteria.
Discharges permitted under the National Pollutant Discharge Elimination System (NPDES) are not subject to the regulation.
You have less than 36 months to achieve compliance with this mandate. Do not risk a legal penalty.
